லோக் சத்தாவின் தேசிய தலைவர் திரு. ஜெயப்ரகாஷ் நாராயண் தலைமையிலான குழு 'நீதித்துறை நியமனங்கள் ஆணைய மசோதா தொடர்பாக பாராளுமன்ற நிலைக்குழுவை நாளை (13-நவம்பர்-2013) புது தில்லியில் சந்திக்க உள்ளனர். இக்குழுவில் தமிழ்நாடு லோக் சத்தாவை சேர்ந்த தலைவர்கள் மூவர் கலந்து கொள்கிறார்கள். இவர்கள் சென்னை மாவட்ட தலைவர் திரு. குமார், மாநில செய்தித்தொடர்பாளர் திரு. ந. நாராயணன் மற்றும் ஆராய்ச்சி & ஆலோசனை துறை செயலாளர் திரு. மகேஷ் குமார் ஆவர்.
'நீதித்துறை நியமனங்கள் ஆணையம்' அமைப்பது (அரசியல் சாசன 120-வது திருத்தம்) லோக் சத்தாவின் முயற்சிக்கு பலனாக கிடைத்தது என்பதை இங்கே நினைவுகூர விரும்புகிறோம்.
'நீதித்துறை நியமனங்கள்' மற்றும் 'இந்திய நீதித்துறை பணிகள்' அமைப்பது குறித்து ஆலோசனை வழங்க லோக் சத்தா கட்சி நேர்மையான, நம்பிக்கைக்குரிய மூன்று மேதகைய நீதிபதிகளை லோக் சத்தா ஒருங்கினைத்ததை இங்கே நினைவுகூருவது குறிப்பிடத்தக்கது. முன்னாள் தலைமை நீதிபதிகள் M.N வெங்கடசலைய்யா, J.S வர்மா, நீதிபதி V.R கிருஷ்ண ஐயர் மற்றும் டாக்டர் ஜே.பி அடங்கிய குழு, உயர் நீதிமன்றங்களில் நீதிபதிகளை நியமனிக்க 'தேசிய நீதித்துறை ஆணையம்' அமைப்பது மற்றும் மாநில அளவில் நீதிபதிகளை நிர்ணயிக்க தேசிய அளவிலான, போட்டித் தேர்வு அடிப்படையில் 'இந்திய நீதித்துறை பணி' முறையை அமைப்பது குறித்த அறிக்கையை வழங்கியது.
மாநிலங்களவையால் ஏற்றுகொள்ளபட்ட மசோதா, மேதகைய மூன்று நீதிபதிகளின் பரிந்துரைகளை தழுவிய வடிவமே ஆகும். இந்த சட்ட மசோதாவானது நீதிபதிகள் நியமனத்தில் செயலாட்சித் துறை, சட்டமன்றம் மற்றும் நீதித்துறையை ஒருங்கிணைத்து, உச்சநீதிமன்றமே யதேச்சையாக நியமிப்பதை தடுக்கும்.
நீதித்துறையில் தற்போது இருக்கும் நியமன முறை அரசியலமைப்புக்கு தெளிவாக முரண்பட்டது. அரசும் அதன் அங்கங்களுக்கும் இடையே உள்ள சமநிலை சரிபார்ப்பு கொள்கைக்கு விரோதமானது. தன்னிச்சையாக நீதிபதிகளை நியமிக்கும் அதிகாரம், அவர்களிடமே இருப்பதென்பது வேறு எந்த குடியாட்சியிலும் காணப்பெறாத ஒன்று. உச்சநீதிமன்றத்தின் கூட்டமைப்பு முறையால் நீதிபதிகளை நியமிப்பது, நடைமுறையில் மனநிறைவை அளிப்பதாக இல்லை. நீதித்துறையின் தரம் மற்றும் நம்பகத்தன்மையை கீழறுப்பதாக உள்ளது. |

| Lok Satta leaders to meet parliamentary panel on Judicial Appointments Bill | ||||||||
Lok Satta Party national President Dr. Jayaprakash Narayan and a team of Lok Satta leaders will be meeting the Parliamentary Standing Committee on The Judicial Appointments Commission Bill, 2013, in New Delhi on Wednesday, November 13. The team from Tamil Nadu comprises of Chennai district president Mr. Kumar, Spokesperson Mr. N. Narayanan and Research & Advocacy wing secretary Mr S.T. Mahesh Kumar.
It may be recalled that the Constitution (120th Amendment) Bill, 2013 providing for creation a Judicial Appointments Commission (JAC) is the culmination of the initiative taken by the Lok Satta.
The Lok Satta had brought together three eminent jurists of unimpeachable integrity and credibility to come up with proposals for judicial appointments and constitution of an Indian Judicial Service. The three judges – Chief Justice M. N. Venkatachalaiah, Chief Justice J. S. Verma and Justice V. R. Krishna Iyer – produced a report recommending formation of a National Judicial Commission for appointment of judges in higher courts and an Indian Judicial Service for competitive, nation-wide recruitment of judges at the district judge level.
The Bill, already adopted by the Rajya Sabha, is a modified version of the proposals made by the three eminent judges. It associates the executive, legislature and judiciary in the appointment of higher judges and does away with the system of the Supreme Court appointing judges of higher courts.
The Lok Satta has all along maintained that usurpation of the power to appoint judges by the Supreme Court is plainly unconstitutional, and violates the principle of checks and balance in relation to organs of the State. The system in practice has been found to be unsatisfactory and undermining the quality and credibility of the judiciary.
