லோக் சத்தா கட்சியின் தமிழ்நாடு மாநில தலைவர் திரு D. ஜெகதீஸ்வரன் அவர்கள் இன்று (25-ஜூலை-2013) சென்னை உயர்நீதிமன்றத்தில் அரசியல் சாசன 97-வது சட்டத்திருத்தத்தின் (2001-ஆம் ஆண்டு) பகுதி 4, அரசியல் சாசனத்தின் அடிப்படை கட்டமைப்பிற்கு எதிராக உள்ளதால் அந்த குறிப்பிட்ட பகுதியை செல்லாததென அறிவிக்கக் கோரி பொதுநல வழக்கு ஒன்றை தொடர்ந்துள்ளார்.
இதையடுத்து மத்திய மற்றும் மாநில அரசுகளுக்கு சென்னை உயர்நீதிமன்றம் நோட்டீஸ் அனுப்பியுள்ளது. வழக்கு வரும் 29-ஆகஸ்ட்-2013 அன்று அடுத்த விசாரணைக்கு ஒத்தி வைக்கப்பட்டுள்ளது.
வழக்கின் பின்னணி:
அரசியல் சாசன 97-வது சட்டத்திருத்ததம் (2001-ஆம் ஆண்டு) கூட்டுறவு சங்கங்களை உருவாக்க சட்டப்பிரிவுக் கூறு 19(1)(c)-இன் கீழ் உரிமை வழங்குகிறது. இது கூட்டுறவு சங்ககளுக்கு அதிகாரம் வேண்டும், அவற்றை அரசியல் பிடியிலுருந்தும் அரசாங்கத்தின் தேவையில்லாத கட்டுப்பாட்டிலிருந்தும் மீட்க வேண்டும் என்ற சீர்திருத்தவாதிகளின் கோரிக்கைகளுக்கு பலனாக அமைந்தது.
எனினும் இந்த சட்டத்திருத்தத்தின் பகுதி 4-இல் உள்ள பிரிவு IX B கூட்டுறவு சங்ககளின் உள்கட்டமைப்பு, அவற்றின் செயல்பாடுகள், மேலாண் குழுமத்திற்கான தேர்தல், பதவிக்காலம், உறுப்பினர் எண்ணிக்கை, இடஒதுக்கீடு ஆகியவற்றை நுணுக்கமாக விவரிக்கிறது.
இது நம் அரசியல் சாசனத்தின் சட்டமியற்றும் அதிகாரத்தின் வரம்பை மீறுவதால் அதை எதிர்த்து இந்த மனு தாக்கல் செய்யப்பட்டுள்ளது. கூட்டுறவு என்பது மாநில பட்டியலில் 32-வது தலைப்பில் உள்ள விஷயம். அது மத்திய பட்டியலில் 43-வது தலைப்பில் சேர்க்கப்படவில்லை. பாராளுமன்றம் பிரிவு IX B-ஐ புகுத்துவதற்கு சட்டப்பிரிவுக் கூறு 368(2)(d) -இன் படி மாநில அரசின் ஒப்புதலை பெற்றிருக்க வேண்டும். ஆனால் பாராளுமன்றம் மாநிலங்களின் ஒப்புதல் இன்றி மறைமுகமாக 7-வது அட்டவணையில் அதிகாரப்பகிர்வுக்கான திருத்தத்தை ஏற்படுத்தியுள்ளது.

Lok Satta Party files PIL in Madras High court: Constitutional amendment on Co-operative societies | |||||
Lok Satta Party, Tamil Nadu president Mr. D. Jagadheeswaran filed a PIL today (25-Jul-13) in the Madras High court challenging the Constitutional validity of Section 4 of the Constitution (97th Amendment) Act, 2011 as being violative of the basic structure of the Constitution.
The court has served notice to the State and Union Governments. The next hearing has been listed for 29-August-2013.
Case Background:
The Constitution (97th Amendment) Act, 2011 includes the right to form co-operative societies within Article 19(1)(c), giving a big boost to the voices of reformists who have been seeking the empowerment of co-operative societies and freeing them from the tyrannies of political interference and undue state control.
However section 4 of the Constitution (97th Amendment) Act, inserted Part IX B which makes detailed provisions in relation to the internal structures and functioning of co-operative societies, including the election, term of office, strength and reservations on their Boards of management.
This Section 4 is under challenge in this Petition as it violates the constitutional framework for division of legislative power. Co-operative societies is a subject in the State List under Entry 32, and is specifically excluded from Entry 43 of the Union List. The Union Parliament has inserted Part IX B without recourse to the amendment procedure which requires states’ ratification under Article 368(2) proviso (d). By this the parliament has altered the distribution of powers in the 7th schedule without states’ approval indirectly.
